REF: Migrant Domestic Worker Wages

Dear Ms. Lammia Yammine Douaihy,

We are writing to express concerns about the current economic crisis and widespread reports from migrant domestic workers in Lebanon of depletion or non-payment of wages, withholding of legal documents such as passports, abandonment outside embassies and exploitative labour conditions.

Our organisation encourages all efforts to protect workers and to improve workers’ quality of life in Lebanon through fairness and equality. The lack of transparency and clear policies from the Ministry of Labour on migrant workers’ rights amid a deepening economic crisis is allowing employers’ exploitation of domestic workers to go unchallenged. We are concerned that the already low wage of migrant workers is not being paid in full by employers as in the original policy.

Similarly to many people in Lebanon, migrant domestic workers are suffering from socioeconomic deprivation due to withholding of wages by employers. At present most employers are unable to pay wages and therefore domestic workers are being exploited for free labour. Under these conditions, it is crucial that migrant domestic workers are able to legally leave their employer without punishment in the form of detention or deportation. Some workers are receiving their wages in LBP at the initial exchange rate of 1,500 which is minus at the current rate. Please can you provide evidence of what is in place to protect these workers’ rights?

The Ministry of Labour’s commitment in September 2020 to issue a revised Standard Unified Contract governing relations between migrant domestic workers and their employers indicated progress towards dismantling the kafala system in line with measures set out in International Labour Convention 189.

On behalf of our affiliates we are requesting that you fulfil your legal obligation and are transparent by providing us with policies regarding Migrant Workers wages and exchange rates if a worker is paid in LBP, and a worker’s right to legally leave their employer if they are being subjected to exploitation and domestic servitude. Over 87,000 global supporters are urging states, including Lebanon, to demonstrate progress in protecting migrant domestic workers’ rights by ensuring workers’ immigration status is not tied to their employers, increasing their vulnerability to exploitation and domestic servitude.

نكتب إليكم للإعراب عن مخاوفنا بشأن الأزمة الاقتصادية الحالية والتقارير واسعة النطاق من عاملات المنازل الوافدات في لبنان عن نضوب الأجور أو عدم دفعها، وحجب الوثائق القانونية مثل جوازات السفر، والتخلي عنهنّ أمام السفارات، وظروف العمل الاستغلالية

إن منظمتنا تشجع كل الجهود المبذولة لحماية العاملات وتحسين نوعية حياتهن في لبنان بالعدل والمساواة. إن الافتقار إلى الشفافية والسياسات الواضحة من وزارة العمل بشأن حقوق العاملات الوافدات وسط أزمة اقتصادية متفاقمة يسمح باستغلال أصحاب العمل لعاملات المنازل استغلالاً لا اعتراض عليه. لدينا مخاوف من أن الأجور المنخفضة أصلاً للعاملات الوافدات لا يتم دفعها بالكامل من قبل أصحاب العمل كما كان الحال في التدابير الأولية

على غرار العديد من الأشخاص في لبنان، تعاني عاملات المنازل الوافدات من الحرمان الاجتماعي والاقتصادي بسبب تمنّع أصحاب العمل عن دفع الأجور. في الوقت الحالي، معظم أصحاب العمل غير قادرين على دفع الأجور، وبالتالي يتم استغلال عاملات المنازل للحصول على عمل مجاني. في ظل هذه الظروف، من الضروري جداً أن تتمكن عاملات المنازل الوافدات من مغادرة صاحب العمل بشكل قانوني دون عقاب عن طريق الاحتجاز أو الترحيل. تتقاضى بعض العاملات أجورهن بالليرة اللبنانية بسعر الصرف الأولي البالغ 1500 والذي ينقص عن السعر الحالي. من فضلكم، هل بوسعكم تقديم دليل على ما هو قيد التطبيق لحماية حقوق تلك العاملات؟

لقد أشار التزام وزارة العمل في أيلول 2020 بإصدار عقد معياريّ موحّد ومنقّح، ينظم العلاقات بين عاملات المنازل الوافدات وأصحاب العمل لإحراز تقدّم نحو تفكيك نظام “الكفالة” بما يتوافق مع التدابير المنصوص عليها في اتفاقية العمل الدولية رقم 189

ونيابة عن المنتسبين لنا، نطلب منكم الوفاء بالتزاماتكم القانونية وبالشفافية من خلال تزويدنا بالسياسات المتعلقة بأجور العاملات الوافدات وأسعار الصرف في حال تم دفع أجر العاملة بالليرة اللبنانية، وحق العاملة في ترك صاحب العمل بشكل قانوني إن تعرضت للاستغلال والعبودية المنزلية. هناك أكثر من 87.000 من المؤيدين حول العالم يناشدون الدول، ومن ضمنها لبنان، على إظهار التقدم في حماية حقوق عاملات المنازل الوافدات من خلال ضمان أن يكون وضعهن كعاملات وافدات غير مرتبط بأصحاب عملهن، الارتباط الذي يزيد من تعرضهن للاستغلال والعبودية المنزلية

  • April 2024:
    In February of 2023, we wrote a story on the a landmark case of a migrant domestic worker taking her former employer and a recruitment agency to court in. The case challenges conditions and treatment under Lebanon’s Kafala system. Accusations include crimes of slavery, trafficking, forced labor, discrimination, and torture spanning over 8 years.

    This case could be groundbreaking for migrant worker protection in Lebanon and the Gulf. 

    However, despite MH’s inability to physically return to Lebanon, Legal Action Worldwide (LAW) who filed the case in 2020, requested remote interrogation by the investigative judge, citing financial constraints, visa obstacles, and fear of retaliation. However, the judge rejected the request.

    In March 2024, LAW appealed for MH’s safety and accessibility in legal proceedings, but the appeal was also rejected.

  • November 2021: Salmo Maya Muktan and Sajita are two Nepalese workers who managed to leave conditions of domestic servitude in Lebanon are owed a decade’s salary by their employers. This has to end let all domestic workers be set free from Kafala system. It’s shameful a country full of learned men and women still treat their domestic workers like animals. This unfair.

This is a degrading situation for workers being treated like this , please help these domestic workers who need our support against being treated like salves

In short, the Kafala System is a horrible situation which should, without hesitation or argument, be quashed by the powers that be.

Violence against men goes deliberately unrecognised today and is getting worse , there have been many social experiments done in public to prove this , males don’t get help they get laughed at

Beirut does not have a working government and I am well aware of this practice having spent time in Beirut. I also had an exhibit here in Hamburg with a woman whose family has someone from Southern Ethiopia. When I spoke about this issue with my friend who hosted me things changed around.

Passports, education, Western privileges and more have to be addressed.
